► Unfair Practice

Unfair practice

The University Regulations defines Unfair Practice as ‘any act whereby a person may obtain for himself/herself or for another, an unpermitted advantage’.
http://www.swansea.ac.uk/registry/A-ZGuide/U/UnfairPracticeProcedure
Unfair Practice happens in examination conditions, non- examination conditions and research degrees.
In examinations this can include (the list is not exhaustive);
Introduce into an examination room any unauthorised form of materials;
copy from or communicate with any other person in the examination room; communicate electronically with any other person;
present an examination script as your own work when the script includes material produced by unauthorised means.  This includes plagiarism.
A fuller list is available on the link above.
Any cases of unfair practice reported during an examination will be investigated and if a case exists a Committee of Enquiry will consider the case.
Any student who has an allegation of unfair practice in an examination is advised to come to the Advice Centre, where we can help formulate a defence and represent in a Committee of Enquiry if necessary.
In non-examinations this involves;
Plagiarism
Plagiarism includes; copying another person's work or ideas. This means copying from other students and from published or unpublished material such as books, internet sources, computer code, etc;
submitting work solicited from (or written by) others.
It is often picked up in departments using particular software called Turnitin to aid in the detection of plagiarism. This scans electronic versions of your assignment and picks up where you have
failed to adequately reference your sources.

Collusion
Collusion is defined by University Regulations as ‘involving two or more students working together, without prior authorisation from the academic member of staff concerned, to produce the same or similar piece of work and then attempting to present this work entirely as their own.  Collusion may also involve one student submitting the work of another with the knowledge of the originator’.
http://www.swansea.ac.uk/registry/A-ZGuide/U/UnfairPracticeProcedure/#Definition%20of%20Unfair%20Practice)
It is easier than you think to fall into the collusion trap. It can involve you discussing an assignment with fellow students, working together in groups, and borrowing notes. This can result in producing similar assignments and allegations of collusion. Do not lend your work to another student; it can lead to an allegation of collusion for you and a more serious allegation of plagiarism for your fellow student. On some occasions, as part of the learning process, you may be instructed to work in groups. Where you are asked to work in groups and to collaborate in specified activities, your teachers should always make it clear. If it is not clear on what basis your work is to be assessed, you should always ask for clarification, before submitting any assignment.
In cases of unfair practice in non-examination conditions, except in post graduate qualifications, the initial allegation is raised by the department and if a first offence is dealt with by the School Unfair Practice Representative. If proven then a penalty is imposed. For penalties in Swansea University Regulations go to:
http://www.swansea.ac.uk/registry/A-ZGuide/U/UnfairPracticeProcedure/#Definition%20of%20Unfair%20Practice)
for section 8.4.2 Penalties.
Further allegations, more serious cases of unfair practice and post graduate studies, are dealt with through a Committee of Enquiry and if proven, the penalties imposed are generally more severe.
In all cases of Unfair Practice we will advise on procedure, help with letters of explanation or mitigation and represent at committees of Enquiry. So if an allegation is made against you come as soon as possible to the Advise Centre or contact us.
